We are currently seeking a high caliber professional to join our department as Legal Counsel, reporting to Deputy General Counsel.
Principal responsibilities
As primary responsibility, to provide legal advice, guidance and support on a variety of contentious matters such as litigation in courts and tribunals, regulatory investigations, arbitration, mediation and internal investigations to ensure that HASE’s exposure to risk associated with these areas is effectively managed.
As secondary responsibility, to provide legal advice and support on cybersecurity, data and digital (e.g. AI) and other corporate (e.g. M&A, employment) matters.
Impact on Business
Provide legal advice and support on all aspects in the contentious and investigation sphere relating to HASE’s business in Hong Kong, including court and tribunal proceedings and processes, contentious regulatory and internal investigation matters (both as claimant and defendant).
Conduct and lead internal reviews and investigations from planning to reporting of all allegations or incidents involving impropriety or possible breaches in law, regulation or policy that pose significant, legal, regulatory and/or reputational risk to HASE, and will require a hands-on approach to evidence gathering, review, interviews and report writing.
Identify emerging trends in relation to litigation and regulatory enforcement actions and develop approaches for mitigating potential legal risk.
Develop and deliver training on areas of primary and secondary responsibilities as needed.
As secondary responsibility and together with other lawyers in the team,
advise relevant stakeholders on cybersecurity (such as preparing cybersecurity contractual provisions and crisis management playbooks), data and digital, and general corporate issues.
support HASE’s transactions, projects or initiatives relevant to corporate matters and where appropriate, liaise with Group in accordance with established protocols.
Customers / Stakeholders
Provide prompt, commercial, practical legal advice in connection with areas falling under primary and secondary responsibilities
Be proactive in the provision of legal support and in advising the business promptly of material legal developments and their implications.
Ensure legal and business management are fully briefed on major issues arising in relevant area and major legislative and case law changes in area of expertise.
Liaise with panel law firms and other appropriate external parties.Develop relationship with and inspire confidence in customers/stakeholders.
Leadership & Teamwork
Maintain and develop positive and professional working relationships with all team members within the HASE legal department and the Global Legal Function, and the relevant business counterparties.
Liaise and collaborate with the business, lawyers across the HASE and HSBC network (as applicable) and other functions in relation to litigation, contentious regulatory and internal investigation matters.
Share knowledge and best practices with legal colleagues.
May manage internal support staff as appropriate.
Ownership over all matters under primary and secondary responsibilities.
Operational Effectiveness & Control
Provide legal services in a cost-effective manner.
Manage the legal risk in legal and business departments for which the jobholder is responsible, to ensure that the interests of the HASE Group are adequately protected.
Assist the business to remain compliant with legal risk management requirements set out in HSBC’s and HASE’s policies and procedures.
Awareness of the operational risk scenario associated with the role and to ensure that all actions during employment with HASE take account of the likelihood of operational risk occurring.
Track record in key types of contentious work in the finance industry in Hong Kong e.g. litigation in courts and tribunals, regulatory investigation by key regulators, arbitration, mediation, overseas litigation
Experience and interest in cybersecurity, data and digital and general corporate (e.g. M&A) matters
Hong Kong qualified lawyer, preferably with 3-8 years of relevant experience
Strong communication skills (both written and verbal) and strong inter-personal skills
Strong sense of ownership
Ability to drive solutions that are commercial, pragmatic and legally sound
Ability to prioritize workloads and handle complex matters
Curiosity and lateral thinking
In-house experience will be an advantage
Fluency in English and Chinese. Fluency in Putonghua will be an advantage
