Reporting to the fintech’s Head of Data Privacy and Regulatory Legal, you will be expected to review fintech products for legal compliance, negotiate commercial partnerships, advise on marketing campaigns (including IP, compliance, and data privacy aspects); advise on competitions, rewards, and programmes. You will sit in the fintech business directly, but with the full support of the wider HSBC Legal team.

Your responsibilities will include:

  • Supporting the business and the Head of Commercial Legal on the review of new partnership agreements, including drafting and negotiating agreements.
  • Supporting the business and the Head of Regulatory and Data Privacy Legal on all new marketing strategies, including reviewing advertising copy, drafting competition terms, developing rewards programmes and advising on strategies across app, social media and website.
  • Liaise with commercial legal, regulatory legal, risk and compliance and other colleagues to help ensure that the product marketing meets all applicable legal and regulatory requirements in a global context when developing and embedding marketing strategy.
  • Build, own and maintain strong relationships internally within the business, in particular with commercial, marketing, technology, regulatory personnel, HSBC legal team and third parties, including external legal advisors, regulators and industry forums where appropriate.
  • Supporting the Head of Data Privacy and Regulatory Legal, Head of Commercial Legal and the General Counsel with matters pertaining to wider legal risk where appropriate. 
Requirements

The ideal candidate for this role will have:

  • Legal knowledge of key risks across marketings, including an awareness of issues in ad tech, app managements, attribution, and social media.
  • Experience of drafting and negotiating marketing documents, including partnership agreements and competitions.  
  • Knowledge of the ASA/CAP code.
  • Legal awareness in several of the following key areas: commercial contracts, data privacy, payments, regulatory and IP (in either the UK and EU, or an APAC jurisdiction), preferably with global retail banking experience including multi-currency operations, payment and cross border transactions, as well as digital banking models and digital wallets.
  • Collaborative with excellent communication skills in translating “legalese”.
