Global Legal plays an important role in protecting the Group’s reputation by helping to future-proof the organisation through robust legal risk and issue advisory. Responsible for providing comprehensive legal advice to senior management and all global businesses and functions, the team offers a diverse range of legal skills, jurisdictional experience, and practice specialisms across all countries and territories in which our businesses operate.

We are currently seeking a high calibre professional to join our team as a Senior Legal Counsel, Securities Services.

Principal Responsibilities

In this role you will

  • Act as a senior legal advisor and lead lawyer to the Hong Kong Trustee and Funds business teams within HSBC’s Securities Services business (SSV) in Asia Pacific Region, which is part of the Markets and Securities Services (MSS) business of The Hongkong and Shanghai Banking Corporation Limited
  • Lead complex projects requiring expert and professional legal advice on all trustee and fiduciary matters in relation to ORSO and MPF schemes.   Knowledge of Hong Kong SFC authorized funds and Cayman Funds is also highly desirable
  • Negotiate complex client transactions and provide timely advice in accordance with HSBC templates and risk parameters set by the Securities Services Business and MSS Legal across ORSO and MPF with a knowledge of Hong Kong SFC authorized funds
  • Support the Head of Securities Services Legal and relevant business leads with new product and template development
  • Provide advice and support with respect to regulatory projects and ensure regulatory risks are brought to the attention of the relevant stakeholders and are addressed and mitigated
  • Provide expert and professional legal advice, guidance and support to ensure that the legal and reputational risks in the Securities Services business lines are identified, reported and mitigated
  • Support the Head of Securities Services Legal and relevant Team Leads with respect to accountability for all ORSO, MPF, Hong Kong SFC Authorised funds and Cayman Funds transactions and projects managed by onshore and offshore lawyers
  • Work closely with a regional and global team of lawyers supporting the Securities Services and Markets business of HSBC
Requisitos

To be successful you will need

  • Ability to adapt workstyle to meet complex and varied workloads across variety of transactions, projects and advisory matters
  • Ability to prioritize workloads in terms of legal risk and commercial consideration
  • Ability to think independently being mindful of maintaining an appropriate balance between management and mitigation of legal risk and business efficacy. Ability to manage a significant number of bespoke or complex requests across a range of transactions, product types and projects
  • Deepening knowledge of areas of specialty with ability to take a view as to how law is developing in order to advise client and reach a solution. Ability to balance the need for further analysis and the need for a timely decision and proper escalations given commercial pressures
  • To establish and maintain relationships with various stakeholders, across multiple geographies and cultural diversities. Build effective relationships with Team Leads and Bangalore offshore legal team as well as global teams
  • To ensure that all transactions and projects are managed in accordance with HSBC Values and comply with SSV business redlines and risk parameters with all risks discussed with business leads and resolved in accordance with HSBC risk appetite, policies and procedures
